PUBLIC NOTICE - ESTABLISHMENT OF THE SUPPLIER REGISTER

With this public notice, the Regional Braille Press ONLUS of Catania announces the establishment of its own Supplier Register for the product categories indicated in Annex A) to the Board of Directors' resolution No. 36 of 26/04/2017, which approved the "Regulations for the Management of the Supplier Register".

Said Regulations and the aforementioned annex of product categories, as well as the forms to be filled out for the submission of the Application for Registration (Annex 1) and the Consent to the processing of personal data (Annex 2), can be downloaded by connecting to the following official website:

All interested Companies, even if already trusted by this Printing House, are invited to submit a specific application for inclusion.

REGULATIONS FOR THE MANAGEMENT OF THE SUPPLIER REGISTER

Art. 1 Subject Matter

These Regulations govern the establishment, maintenance, publicity, and methods of use of the Supplier Register for purchases concerning supplies of goods, provision of services, and execution of works, carried out by the Regional Braille Press ONLUS of Catania in compliance with the rules provided for by the new Public Procurement Code (hereinafter referred to only as the Code).

The Supplier Register, through a system of accreditation and rotation, aims to guarantee compliance with the principles of free competition, equal treatment, non-discrimination, transparency, and proportionality in identifying the companies to be invited to negotiated procedure tenders.

Registration in the register takes place upon application by the interested parties, subject to verification of the eligibility requirements.

The Register is divided into product categories of works, services, and supplies.

The Register is open-ended; therefore, Economic Operators meeting the requirements may request registration for the entire duration of the Register itself.

The annexes to these Regulations have substantial value and form an integral part thereof.

 

Art. 2 Scope of Application

The Register will be used to identify qualified Economic Operators to be consulted for the awarding of works, services, and supplies, and for procedures relating to urgent or extreme urgency interventions.

The Printing House nevertheless reserves the right to proceed with the acquisition of works, goods and/or services through public tender procedures, in compliance with current legal provisions.

The Printing House may also use the list referred to in these regulations to choose the economic operator in the direct award procedure.

 

Art. 3 Prior Publication

The formation of the Register takes place following the publication of a specific notice on the Printing House's website.

The notice will indicate the procedures for requesting registration and the documentation to be submitted.

 

Art. 4 Requirements for Registration

In order to obtain registration in the Register, the Economic Operator must possess the following requirements:

  • registration with the Chamber of Commerce, Industry, Handicrafts and Agriculture for the activity relating to the category for which registration is requested;
  • possession of the general requirements provided for by Art. 80 of the Code;

The possession of the requirements must be self-certified by means of a statutory declaration made pursuant to Articles 46, 47, and 76 of DPR 445/2000.

The Printing House reserves the right to carry out checks on the declarations made.

At any time, should it deem it necessary, the Printing House may request registered members to send certificates or other documentation proving the continuation of the objective and subjective requirements.

After registration, under penalty of ex officio cancellation, any change that has occurred regarding the data transmitted or inherent to the possession of the requirements referred to in Art. 80 of the Code must be promptly communicated.

 

Art. 5 Registration Procedure

The Economic Operator intending to be included in the Register must send the registration application (Annex 1) to the Printing House from the day following the publication of the notice, with no deadline, digitally signed or in original by the Legal Representative and accompanied by the required documentation, to be sent to the certified email (PEC) address direzione@pec.stamperiabrailleuic.it or delivered in paper format to the Registry Office of the Printing House, Via Aurelio Nicolodi n. 4, 95128 Catania.

The Economic Operator must indicate the activity carried out and the product category, chosen from those indicated in the annex to the resolution approving these regulations, for which registration is requested.

Registration may be requested in multiple product categories, provided that the registration requirements stipulated by these Regulations are met.

An Economic Operator already registered in the Supplier Register may request changes to the product category of registration at any time by means of a specific application accompanied by documentation proving the existence of the required requirements.

Submission of applications for the same product category both individually and as a member of consortia is prohibited.

Submission of applications for the same product category as a member of multiple consortia is prohibited.

Without prejudice to the requirements referred to in Article 80 of the Code, situations of control and affiliation are determined with reference to the provisions of Article 2359 of the Italian Civil Code.

Applications submitted prior to the publication of the notice, as well as those not complying with the prescribed requirements, will not be taken into consideration.

All Economic Operators who, following an application submitted in accordance with the methods indicated in these regulations, do not receive a notice of refusal of registration or a request for additional documentation, are to be considered included in the Register.

If the documentation submitted is not complete or exhaustive, the registration procedure remains suspended until the Entity provides the requested integration.

 

Art. 6 Person in Charge of the Procedure

The Person in Charge of the Procedure is the General Director of the Printing House or a person formally delegated by them.

They are responsible for publishing the Register on the official website and for correctly entering the data into the specific register management applications.

The evaluation of applications for inclusion or modification and the updating of the Register, within thirty days of the application, falls within the competence of said person in charge.

 

Art. 7 Use of the Register

The selection of Economic Operators to be invited within each product category, compatibly with the specific objectives to be achieved, may take place either by draw or by following a rotation criterion subject to a comparative examination of the requirements possessed; it is also possible to extend the invitation to the outgoing contractor, subject to adequate justification, having regard to the small number of operators present on the market, the degree of satisfaction achieved at the conclusion of the previous

contractual relationship (workmanship executed to the highest standards, in compliance with the agreed timelines and costs), or the object and characteristics of the reference market.

Registration on the list is not mandatory for the purpose of being invited to tender procedures or for the awarding of works, services, and supplies.

The inclusion of the Company in the Supplier Register does not constitute a title to claim the awarding of works, services, or supplies, and the Printing House is in no way bound towards the registered Economic Operator.

Economic Operators not specifically invited will not be admitted to the consultation phase.

Economic Operators registered in the Supplier Register shall have no claim if the Printing House does not proceed with acquisitions in the product branch of interest or does not carry out procedures in such quantities that the entire list of registered subjects cannot be scrolled through.

 

Art. 8 Deletion from the Register

Deletion from the Register is provided for in the following cases:

  • subsequent lack of the requirements referred to in the previous Art. 4;
  • failure to comply with Art. 11 of these regulations;
  • failure to submit an offer following the invitation to tender for two
  • consecutive times, without providing an adequate written justification;
  • ascertained serious negligence or bad faith in the execution of the performance;
  • following a written request by the interested party.

Deletion precludes re-registration for three years.

The deletion procedure will be initiated with a communication to the Economic Operator, setting a deadline of 15 days for any counter-deductions.

Once this deadline has expired, in the absence of valid counter-deductions, the deletion becomes final.

 

Art. 9 Privacy

The Printing House, pursuant to Legislative Decree No. 196 of 30 June 2003 as data controller for the processing of data provided for registration in the Supplier Register, informs that such data will be used only for the purpose of registration in the Supplier Register and will be processed using electronic and manual systems, in such a way as to guarantee their security and confidentiality.

By submitting the application for admission, the economic operator therefore expresses its consent to the aforementioned processing.

 

Art. 10 Obligations for the Traceability of Financial Flows

Economic Operators registered in the Register must comply with the provisions of Art. 3 of Law No. 136/2010 for the purpose of traceability of financial flows relating to public contracts.

 

Art. 11 Administrative Liability pursuant to Legislative Decree 231/01

In relation to the provisions of Legislative Decree No. 231 of 8 June 2001 and subsequent amendments and integrations, the Printing House has adopted a specific Organization, Management, and Control Model and the Code of Ethics, as documents defining the set of ethical values and behavioral rules that the Printing House recognizes, accepts, and shares, and compliance with which allows, among other things, to prevent the commission of offences provided for by said Decree.

It is a primary interest of the Printing House that all those entering into business relations with it carry out their activities in compliance with the principles and values contained in said documents, which can be consulted on the following website: www.stamperiabrailleuic.it in the "Transparent Administration" section.

By registering in the Register, economic operators adhere to the principles set out in the Organization, Management, and Control Model and in the Code of Ethics of the Printing House.

The serious or repeated violation of the principles contained in said documents is considered a breach of contractual obligations towards the Printing House and results in deletion from the Register.

Deletion from the Register may nevertheless be activated by the Printing House in the event of the commission of an offence provided for by Legislative Decree 231/01, even if not in relation to relations with it, established by a final judgment recognizing the liability of the economic operator or following the application of the penalty at the request of the parties pursuant to Art. 444 of the Italian Code of Criminal Procedure, as well as in the event of the imposition, even as a precautionary measure, of disqualifying sanctions such as the ban on contracting with the public administration or disqualification from exercising the activity. In any case, upon the possible opening of criminal proceedings against the supplier for relevant offences pursuant to Legislative Decree 231/2001, immediate information must be provided to the Printing House.

Economic Operators registered in the Register hereby indemnify the Printing House against any penalties or damages that may arise for the latter as a consequence of the violation of the aforementioned documents by themselves or by any of their collaborators.

 

Art. 12 Publicity

These Regulations and any amendments thereto, notices, and forms relating to registration in the Supplier Register will be published on the Printing House website: www.stamperiabrailleuic.it in the "Transparent Administration" section.

The Supplier Register will also be published on the aforementioned website.

 

Art. 13 Coordination Rules

For anything not expressly provided for in these Regulations, reference is made to current laws and regulations on the subject.
